As a general rule, employers are obliged to accommodate reasonable requests by employees suffering disabilities to facilitate the employee being able to perform his or her role. This includes a legal requirement for employers to make positive and reasonable adjustments for an employee who has suffered a disability to perfom duties at work arising from non-work related injuries and illnesses. In Panazzolo v Don’s Mechanical and Diesel Service Pty Ltd [2023] FedCFamC2G 665 for example the Federal Circuit Court held that an employer had a positive obligation to make reasonable adjustments to the workplace and workplace practices to facilitate an employee returning to work after being injured in a non-work related assault.
