Workplace health and safety laws

All States except Western Australia and Victoria have signed on to harmonize their work health and safety laws by legislating to comply with the national model WHS model laws (see
Western Australia intends to legislate to comply with them by 95% by the end of calendar 2014. The WA government has political difficulties with some of the elements of the national model laws in relation to union right of entry, the ability of local health and safety delegates to instruct cessation of operations, the reverse onus of proof in discrimination cases and penalties some of which are regarded by the WA government as excessive.
