Under sec 114 of the Fair Work Act, an employer may request an employee to work on a public holiday, against the employee’s wishes provided that the request is reasonable. The provision also sets out the factors to be taken into account in determining whether the request is reasonable. Those factors include ( but are not limited to)
The nature of the workplace
The employee’s personal circumstances including family responsibilities
The level of remuneration which will be earned
Whether the employee is a full time, part time or casual employee
The amount of notice which is provided.
