Suspension of employment

An employer does not have a common law right to suspend the employment of an employee even if there has been misconduct which would justify immediate dismsal; see Macken’s Law of Employment 8th ed. at 7.20 and excluding an employee for the workplace as a disciplinary measure without the legal authority derived from the conttract of service, or an award or enterprise agreement,  would constitute an unlawqful suspension; Macken at 7.30.
