Recovery of entitlements

Webb v Stratton Finance Pty Ltd (2014) FCCA 924 delivered on 9 May 2014 is a classic Federal Court decision which explains how employees who have been underpaid statutory entitlements can take proceedings to recover those underpayments, and also pursue claims such as breach of contract under the accrued jurisdiction of the Court. The case also explains how and why civil penalties (fines by another name) can be ordered to be paid against an employer to an employee. The employer was also ordered to pay the costs of the case.
