Odco arrangements; what are they?

The expression Odco style arrangement, often encountered in employment law circles, is a reference to a system under which a labour hire employer hires its employees out to third parties in a legitimate way as opposed to the arrangement being a sham to disguise that the recipient of the service is really the employer.

The case was closely studied by a Full Bench of the Federal court in Fair Work Ombudsman v Quest South Perth Holdings Pty Ltd [2015] FCAFC 37 (17 March 2015) which also involved a complex analysis of the nature of the representation which is prohibited by sec 357 of the Act which renders it unlawful for an employer to falsely label and employment relationship as one of principal and contractor.
