New anti-bullying regime

The new workplace anti-bullying regime kicks off in the Fair Work Commission on 1 January 2014. The new jurisdiction, which is regarded as first in the world legislation will enable the anti-bullying panel of the Fair Work Commission to grant enforceable orders to stop workplace bullying, but not compensation.
Until now, employees victimized at work by bullying, whether from colleagues or managers, have had little redress unless the bullying has induced a compensable event under workers’ compensation laws, or has constituted a failure by the employer to provide a safe system of work in occupational health and safety regulators’ jurisdictions or even where there has been a fundamental failure by the employer to tackle the issue and that failure has constituted a constructive dismissal.
