Fines (technically known in this area of the law as pecuniary penalties) for breaches of the general protections

“By virtue of Item 11 of the table in s 539(2) of the FW Act, s 340 of the FW Act is a civil remedy provision. Pursuant to s 546, a Court may impose a pecuniary penalty for a contravention of a civil remedy provision. Section 546(2) provides as follows:

“(2)         The pecuniary penalty must not be more than:

(a)          if the person is an individual—the maximum number of penalty units referred to in the relevant item in column 4 of the table in subsection 539(2); or

(b)          if the person is a body corporate—5 times the maximum number of penalty units referred to in the relevant item in column 4 of the table in subsection 539(2).”

The maximum number of penalty units with respect to a contravention of s 340 is 60 penalty units.[10] The rate of a penalty unit is determined by s 4AA of the Crimes Act 1914 (Cth).”
