Fine for adverse action

In Construction, Forestry, Mining and Energy Union v BHP Coal Pty Ltd (No 4) [2013] FCA 762 BHP was fined 90% of the maximum penalty available for failing to be able to discharge the reverse onus of proof in an action by two union officials who claimed to be the victims of adverse action due to their status as union officials. BHP was fined $60,000. The maximum penalty available to the Federal Court judge was $66,000.
