Fair Work Commission to rule on workplace vaccinations

A union of workers, the Construction, Forestry, Maritime, Mining and Energy Union and one of its members, a Mr Howard have together referred an industrial matter said to arise under an enterprise agreement and involving a dispute as to the power of a mining company employer to require employees to be vaccinated against Covid 19 as a condition of entry to site for determination by the Fair Work Commission;

These are the terms of the dispute

“Whether the direction as set out in attachments 1 and 2 to the application filed by the CFMMEU in proceedings C2021/7023 is a lawful and reasonable direction in respect to employees at the Mt Arthur mine who are covered by the Mt Arthur Coal Enterprise Agreement 2019”

On 1 November 2021 a very senior Full Bench of the Fair Work Commission, headed by its President Justice Ross, ordered that the matter be set down for hearing on 24 November 2021.
