ET don’t phone home; personal use of employer’s phone

An NBN employee who accumulated $23,000 in debt through use of a company mobile phone for personal overseas calls, has lost an unfair dismissal case brought in an attempt to overturn the dismissal which was based upon his refusal to agree to one of a number of company proposed repayment plans. Deputy President Gooley made it clear that a dismissal would not have been justified based just on the incurring of the debt because there was insufficient evidence that the employee was aware of the NBN policies which discouraged the person use of company phones.
